Terms of Use

1. Contracting Party

In these Terms, "PlateCue," "we," "us," and "our" mean MyTip Innovations s.r.o. when it provides the PlateCue app, website, backend, subscription features, and support channels.

2. Acceptance

By downloading, accessing, purchasing, or using PlateCue, you agree to these Terms, the Privacy Policy, the Subscription Terms, the Nutrition and AI Disclaimer, and the Apple Standard End User License Agreement available at apple.com/legal/internet-services/itunes/dev/stdeula/.

If you do not agree, do not use PlateCue. If there is a conflict between these Terms and the Apple Standard EULA for an App Store-distributed copy of PlateCue, the Apple Standard EULA controls to the extent required by Apple.

3. Eligibility and Personal Use

PlateCue is intended for personal consumer wellness use by people who can make their own nutrition decisions or use the app with appropriate adult and professional guidance. PlateCue is not directed to children and should not be used by minors without appropriate supervision.

You may not use PlateCue if doing so would violate applicable law, App Store rules, these Terms, or any restriction imposed by Apple or another platform provider.

4. What PlateCue Does

PlateCue helps users estimate, correct, save, and review nutrition information from meal photos, typed notes, dictated notes, and other user inputs. PlateCue is designed for personal awareness and daily plan check-ins, not for clinical care, exact food measurement, or professional nutrition services.

5. Wellness-Only Disclaimer

Do not use PlateCue for emergencies, eating disorder treatment, pregnancy care, diabetes dosing, allergy safety, medical nutrition therapy, medication decisions, pediatric nutrition, or any medical decision. Consult a qualified healthcare or nutrition professional for medical conditions, pregnancy, eating disorders, allergies, minors, or specialized nutrition needs.

6. Approximate Estimates

Photo-based nutrition analysis can be incomplete or wrong. A photo may not show weight, volume, recipe details, hidden oils, sauces, cooking method, packaged ingredients, brands, or restaurant preparation. PlateCue displays confidence cues and correction tools because estimates are starting points.

You are responsible for reviewing and correcting estimates before relying on them. PlateCue does not guarantee weight loss, muscle gain, health outcomes, macro adherence, calorie accuracy, or any other result.

7. Your Responsibilities

• Use PlateCue only for lawful, personal wellness purposes.
• Do not upload unlawful, abusive, explicit, private third-party, non-meal, or rights-infringing content.
• Do not attempt to reverse engineer, overload, scrape, disrupt, attack, bypass access controls, or misuse PlateCue, the backend, or any provider systems.
• Do not use PlateCue to provide professional medical, nutrition, coaching, diet, or regulated advice to others unless you have appropriate qualifications and independent professional obligations.
• Keep your device, Apple account, backups, and subscription settings secure.
• Respect Apple App Store rules, payment rules, and platform terms.

8. User Content and License

You retain your rights in photos, notes, corrections, and other content you provide. You grant PlateCue a limited, worldwide, non-exclusive, royalty-free license to process that content only as needed to provide, secure, troubleshoot, support, and improve PlateCue, subject to the Privacy Policy.

PlateCue is designed not to intentionally retain raw meal photos or correction text after an analysis or correction request is serviced by the backend. Meal logs and saved meals are stored locally on your device unless you use a future sync feature governed by updated terms and privacy disclosures.

9. Subscriptions and Purchases

Premium features may be offered through Apple in-app purchase. Apple handles payment processing, cancellation, refunds, billing records, subscription management, territory pricing, taxes, and purchase confirmation. Prices, billing periods, renewal terms, trial terms, and eligible offers will be shown in the app before purchase.

Subscriptions automatically renew unless canceled through Apple at least 24 hours before the end of the applicable billing period. Deleting PlateCue local data or uninstalling the app does not automatically cancel an Apple subscription. See the Subscription Terms for more detail.

10. Privacy and Data Controls

PlateCue's privacy practices are described in the Privacy Policy. The app provides local export and local deletion controls in Settings. The Privacy Choices page explains available data controls and privacy request paths.

11. Intellectual Property

PlateCue, including its app, website, brand assets, designs, code, text, generated assets, workflows, and other materials, is owned by MyTip Innovations s.r.o. or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from PlateCue except as permitted by law or these Terms.

12. Third-Party Services

PlateCue depends on Apple services for distribution, in-app purchase, subscription management, refunds, and device permissions. PlateCue may also use hosting, CDN, DNS, AI, email, support, and security providers. Your use of those services may also be subject to their terms and policies.

13. Changes, Suspension, and Termination

PlateCue may change, suspend, or discontinue features, prices, availability, providers, or the app as a whole. PlateCue may suspend or restrict access if needed to protect users, the service, legal compliance, App Store compliance, security, or provider systems. You may stop using PlateCue at any time and delete local app data from Settings.

14. Disclaimers

To the maximum extent permitted by law, PlateCue is provided "as is" and "as available." PlateCue disclaims warranties of accuracy, completeness, fitness for a particular purpose, non-infringement, uninterrupted service, availability, and error-free operation.

Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.

15. Limitation of Liability

To the maximum extent permitted by law, PlateCue and MyTip Innovations s.r.o. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; loss of data; device issues; health decisions; nutrition decisions; subscription decisions; or reliance on inaccurate estimates.

Where liability cannot be excluded, PlateCue's liability will be limited to the maximum extent permitted by applicable law.

16. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MyTip Innovations s.r.o. from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of PlateCue, violation of these Terms, violation of law, or infringement of third-party rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the Czech Republic, excluding conflict-of-law rules, except where mandatory consumer protection laws in your country or state provide rights that cannot be waived.

Subject to mandatory consumer rights, disputes relating to these Terms or PlateCue will be handled by the competent courts of the Czech Republic. If you are a consumer, you may also have the right to bring claims in the courts or complaint bodies available under mandatory law where you live.

18. Apple Terms

For App Store-distributed copies of PlateCue, Apple and Apple's subsidiaries are third-party beneficiaries of the Apple Standard EULA and may enforce it against you. Apple is not responsible for PlateCue's content, maintenance, support, warranty claims, product claims, or legal compliance except as Apple separately states in its own terms.

19. Changes to These Terms

PlateCue may update these Terms as the product, business, providers, launch territories, or legal requirements change. Material updates should be reflected on this page and, where appropriate, in the app or release notes. Your continued use after an update means you accept the updated Terms, where permitted by law.
